These Terms of Service (the "Terms") govern your use of Submittal Kit, the website and application at submittalkit.com (the "Service"). The Service is operated by Six Two Whiskey LLC, doing business as Submittal Kit ("Submittal Kit," "we," "us," or "our").
Submittal Kit is a business tool for control system integrators. Please read these Terms carefully — they include important limits on our liability and a section on your professional responsibilities. If you do not agree to these Terms, do not use the Service.

01 Acceptance and Authority
By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a company or other organization, you agree to these Terms for that organization, and you represent that you have the authority to bind it. In these Terms, "you" means both you as an individual user and the organization you represent.
The Service is intended for business use only. It is not directed to consumers or to anyone under 18 years of age, and you may not use it if you are under 18.
02 The Service
Submittal Kit is a business-to-business, multi-tenant software service. It helps control system integrators manage PDF datasheets in a shared parts library and compile operations and maintenance (O&M) manuals, submittal packages, and as-built redline submittals for electrical control panels.
The Service organizes documents and data that you provide and assembles them into compiled submittals. Some features use automated and AI-assisted document analysis, such as locating and verifying catalog-number highlights on datasheets. Please read Section 7 for important limits on what the Service does and does not do.
03 Accounts and Workspaces
The Service is organized into workspaces, one per company. Workspaces are provisioned by a Submittal Kit administrator after review of a workspace request; submitting a request does not by itself create an account.
Each user belongs to exactly one company workspace, matched by email domain — for example, everyone using an @acme.com address joins the Acme workspace. Company admins can also send single-use email invites to add members.
- Admins manage members and company settings for a workspace.
- Members work on projects within the workspace.
You sign in with an email address and password. A magic sign-in link sent by email is available as a secondary sign-in and password-recovery method. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Tell us promptly at [email protected] if you believe your account has been compromised. Your organization is responsible for the acts and omissions of its users, and its admins control who has access.
Submittal Kit system administrators may access company workspaces to provision, support, and administer the Service.
04 Fees
Paid plans are billed through our payment processor, Stripe. When your company purchases a paid plan, you authorize us to charge your payment method, through Stripe, for the applicable fees at the time of purchase and at each renewal or plan change — at the price and billing cycle then in effect, or as set out in a separate written agreement or order form. We do not store your full payment card details; Stripe collects and processes them directly.
Paid plans may include a free trial. When a trial is offered, we will show you the trial length and the price that applies after it before you start. If you cancel before the trial ends, you will not be charged; if you do not cancel, your paid subscription begins when the trial ends and your payment method is charged as described above.
Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law or expressly stated otherwise, fees are non-refundable. Fees are exclusive of taxes; you are responsible for any applicable sales, use, or similar taxes, other than taxes on our income.
If a payment fails or an account is past due, we may suspend access to paid features after reasonable notice. We may change fees on reasonable prior notice; changes take effect at your next renewal, and if you do not agree, you can cancel before the renewal takes effect.
05 Your Content and Rights
"Your Content" means the documents, data, and materials you upload to or create in the Service — including datasheets, product manuals, panel drawings, specifications, policy documents, returned or marked-up review documents, bill-of-materials files, logos and branding assets, project and parts data, annotations and redline markups, personnel rosters and emergency contact information, and the compiled submittals generated from your inputs.
As between you and us, you own Your Content and the compiled submittals generated from it. You grant us a limited, non-exclusive license to host, store, process, display, and transmit Your Content solely to provide and support the Service.
You are responsible for having the rights and consents needed to provide Your Content to us and to use it in the Service. This includes two areas that matter for this product:
- Personnel data. Personnel rosters, certifications, and emergency contacts are personal information about your own employees. You represent that you have the right to provide this information to us and to include it in compiled submittals.
- Third-party datasheets. Manufacturer datasheets and manuals are typically copyrighted documents owned by others. You represent that you have the necessary rights to upload and use them in the Service.
If you believe content on the Service infringes your copyright, contact us at [email protected] with enough detail to identify the work and the material at issue, and we will review and respond.
06 Acceptable Use
You agree not to:
- upload or use content that is unlawful or infringes the rights of others;
- interfere with, disrupt, or probe the security of the Service or its infrastructure;
- attempt to gain unauthorized access to another workspace, account, or data;
- reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by law;
- resell the Service or use it to provide a service bureau to third parties; or
- use automated means to scrape or extract data from the Service, except through features we provide for that purpose.
We may suspend or limit access to protect the Service, its users, or third parties, or to comply with the law.
07 Professional Responsibility
This section is important. Please read it carefully.
Submittal Kit is a document-compilation tool. It is not an engineering service, and it does not perform engineering review. We do not review your submittals for accuracy, completeness, or code compliance.
Compiled submittals are generated from the inputs you provide. Some features use automated and AI-assisted highlighting, and these features can make mistakes — for example, a catalog-number highlight may be placed incorrectly or missed.
You and your licensed professionals are solely responsible for reviewing every submittal for accuracy, completeness, and code compliance before submitting it or relying on it. Do not treat any output of the Service as a substitute for professional engineering judgment.
08 Retention and Recordkeeping
Compiled working copies are temporary. They expire and are automatically deleted about 24 hours after compilation.
When you formally submit a package, we mint an immutable revision snapshot of the exact compiled file and retain it as part of your submittal log. These snapshots — and any returned or marked-up review documents attached to a revision — persist, because keeping a record of what was sent is the core purpose of the Service. Library documents you upload are stored and shared within your company workspace.
Account and company workspace data is retained while your workspace is active. If your workspace is terminated, we delete this data after the wind-down and export period described in Section 11, except for the revision snapshots and other records described above, billing and invoice records we keep for tax, accounting, and other compliance purposes, and any records we are otherwise required or committed to keep.

09 Availability; Service Updates
We work to keep the Service available and reliable, but we do not guarantee any level of uptime and do not offer a service-level agreement. The Service may be unavailable from time to time, including for maintenance.
The Service will change over time. We may add, modify, or discontinue features as the Service evolves. We will try to avoid disrupting your work, but we are not liable for changes to features you have come to rely on.
10 Our Intellectual Property and Feedback
We own the Service, including its software, design, and branding, and all related intellectual property rights. These Terms do not grant you any rights in the Service except the limited right to use it as described here. The "Submittal Kit" name and our logos are our trademarks, and you may not use them without our permission.
If you send us feedback, suggestions, or ideas about the Service, we may use them without any obligation or compensation to you.
11 Term and Termination
These Terms apply while you use the Service. You may stop using the Service at any time, and either party may terminate access to a workspace. We may suspend or terminate access if you violate these Terms or if we need to for legal or operational reasons.
On termination, your right to access the Service ends. Termination does not relieve you of the obligation to pay any fees accrued before the termination date. If you ask during a reasonable wind-down period after termination, we will give you a reasonable opportunity to export Your Content. After that period, we will delete account and company data in line with Section 8 and our Privacy Policy. Revision snapshots and other records we are required or committed to keep may be retained as described in those documents.
12 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY COMPILED SUBMITTAL OR AUTOMATED OR AI-ASSISTED OUTPUT WILL BE ACCURATE OR COMPLETE. AS DESCRIBED IN SECTION 7, YOU ARE RESPONSIBLE FOR REVIEWING ALL SUBMITTALS BEFORE RELYING ON THEM.
13 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, OR LOST OR CORRUPTED DATA, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) US $100.
THESE LIMITS APPLY TO ALL CLAIMS, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, AND REFLECT THE ALLOCATION OF RISK BETWEEN US.
14 Indemnification
You will defend, indemnify, and hold harmless Submittal Kit and its officers, employees, and agents from and against any third-party claims, damages, liabilities, and reasonable costs (including reasonable attorneys' fees) arising out of or relating to Your Content, your use of the Service, or your breach of these Terms.
We will give you prompt notice of any such claim, and you will have control of its defense and settlement, provided that we may participate with counsel of our own choosing at our expense, and you will not settle any claim in a way that admits fault by us or imposes obligations on us without our prior written consent.
15 Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Florida for any dispute arising out of or relating to these Terms or the Service.
16 Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will give you reasonable notice by email or within the Service before it takes effect. Your continued use of the Service after a change takes effect means you accept the updated Terms. If you do not agree, stop using the Service.
17 General
- Entire agreement. These Terms, together with the Privacy Policy and any separate written agreement or order form, are the entire agreement between you and us about the Service and supersede any prior understandings on that subject.
- Severability. If any provision of these Terms is held unenforceable, the rest remain in effect, and the unenforceable provision will be applied to the maximum extent permitted.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Survival. Sections that by their nature should survive termination — including your obligation to pay fees accrued before termination and Sections 5 through 8 and 10 through 17 — survive.
